The rules for using this website and the Aether contracts on Elysium, in plain words. Please read them, and the risks in particular, before you summon or trade.

The short version

  • Aether lives in public smart contracts on Elysium. This website is one way to use them, and the contracts keep working without it.
  • Your wallet is yours alone. We never hold your keys, tokens or HYPE, and we cannot reverse a transaction or recover a lost wallet.
  • Every summon is final: the contracts have no way to refund a mint.
  • Aether is not an investment. We promise no roadmap, utility or value, and an Aether can lose all of its value.
  • Using Aether carries real risks. Please read section 11, Risks, before you take part.
  • Quest Board campaigns are free and run on trust: the top entries are checked by hand before any reward, and X has no part in them. The rules are in section 6.

This summary helps you find your way. It does not replace the full terms below, which apply in full.

About these terms

These Terms of Use apply to this website and to everything you do with Aether through it. By using the website, or by summoning through it, you agree to these terms. If you do not agree, please do not use the website.

In these terms, “we”, “us” and “the Aether team” mean the anonymous creator of Aether, who runs this website. “You” means anyone who uses the website. The “collection owner” is the address that holds the owner role in the Aether contract; at launch, that address is controlled by the Aether team.

How the website handles data is explained in the Privacy Notice.

What Aether is

Aether is a collection of pixel familiars: ERC-721 tokens recorded by the Aether contract on Elysium, a blockchain network whose fees are paid in HYPE. Onchain, the collection is named Aetherelysium, with the ticker AETHERELYSIUM. The art and the details of every Aether are produced by the contracts themselves, onchain.

This website is an interface. It reads the public contracts and prepares transactions that your own wallet shows you, signs and sends. The contracts do not depend on the website: they keep working if it changes or goes offline, and anyone can use them through other tools, such as a block explorer.

We may change, pause or take down the website, or any part of it, at any time and without notice.

This copy of the website is connected to Elysium Testnet, a test network. On a test network, HYPE and Aether are for testing only and are not meant to have any monetary value.

Who may use Aether

You may use the website and the contracts only if all of the following are true:

  • you have reached the age of majority where you live;
  • you are not named on a sanctions list, you are not owned or controlled by anyone who is, and you are not in a country or region under comprehensive sanctions;
  • no law that applies to you forbids you from using them.

The website does not check your age, location or identity. It is up to you to make sure you are allowed to take part, and you are responsible for following the laws that apply to you, including tax laws.

Your wallet

Aether works with self-custody wallets, such as a browser extension or a wallet app. You alone hold your keys and your seed phrase (also called a recovery phrase).

  • We never hold your keys, tokens or HYPE, and we cannot move them for you. The website never asks for your seed phrase. Apart from the Control Room, which only the collection owner uses, the only message it asks you to sign is the free sign-in for a Quest Board campaign, which moves nothing and approves nothing. Any other signature request is not from us. It asks your wallet to connect and to use Elysium, and it proposes transactions, which your wallet shows you before you approve them.
  • Transactions are final. Once a transaction is confirmed, we cannot reverse it, cancel it or send back what it moved.
  • We cannot recover anything. If you lose access to your wallet, or someone else learns your seed phrase, we cannot restore your tokens or HYPE.
  • You pay gas in HYPE for every transaction you send, even one that fails.
  • Send HYPE to the contracts only through a summon. A plain transfer to the contracts fails, and HYPE attached to some other calls, such as an approval or a token transfer, stays in the contract and is not refunded.

Summoning

Summoning is how new Aether are minted. Each summon creates sealed vessels, and each vessel later reveals the familiar inside.

Price and gas

Each vessel costs the price set in the Aether contract, paid in HYPE, and every summon also costs gas. The mint page shows the current price before you sign, and the price is the same at every care level. The collection owner can change the price at any time. Your transaction must pay exactly the price times the quantity, so if the price changes before your transaction is included, it fails instead of charging you a different amount, and you still pay its gas.

The per-wallet limit

Each wallet address can summon up to the per-wallet limit shown on the mint page, counted over its whole lifetime. The collection owner can set that limit anywhere from 1 to 100. It counts only the vessels that address summoned itself: tokens received by transfer, and free mints by the collection owner, do not count. The limit applies per address, not per person. A summon that would go past your limit, or past the remaining supply, fails as a whole; it is never filled in part.

Sealed vessels

Your vessels arrive in your wallet straight away, sealed. What is inside each one is decided by the hash of an Elysium block that does not exist yet when you summon, so neither you nor we can know or choose the outcome in advance. The one theoretical exception is the network’s sequencer (see Risks).

From the third block after your summon, usually less than a second later, the seals can be broken. Anyone can break waiting seals, for anyone, and seals always open in summon order, so who breaks them, and when, does not change any outcome within the unseal window. A sealed vessel cannot be transferred until its seal can break: a transfer first breaks the waiting seals up to it, and fails if it cannot.

The unseal window

The block hash that decides a seal can only be read for a limited time: the contract can read the hashes of the latest 393,168 blocks, which cover about 11 hours at Elysium’s fastest pace and longer when blocks are slower.

If a vessel is not unsealed within that window, it is not lost and nothing is refunded. It is revealed from a fixed fallback value instead of the block hash. That value depends only on the summon itself, so anyone could have worked it out as soon as the summon was confirmed. Right after a summon the website asks its own opener to break your seals, so they usually open within seconds; if it cannot (for example when it is offline or out of gas money), unseal your vessels yourself in My Aether soon after you summon them. We may also unseal waiting vessels from time to time, but we do not promise to, and the contracts do not require anyone to.

Care quests

Before you sign, the mint page offers three short care quests. Your care is fixed in the summon itself: full care means none were skipped, and each quest you skip lowers it by one.

  • Full care keeps the published odds: Peasant 46%, Squire 27%, Knight 15%, Champion 8%, Sovereign 3% and Ascendant 1%.
  • Skipping lowers the odds of every rank above Peasant. Each quest you skip makes every rank above Peasant 5% less likely than published, and Peasant takes the difference. With every quest skipped, those ranks are 15% less likely: Peasant 54.10%, Squire 22.95%, Knight 12.75%, Champion 6.80%, Sovereign 2.55% and Ascendant 0.85%.
  • Care is never sold. The price is the same at every care level, and nobody can pay for better odds. The contract cannot tell whether you did the quests, so anyone who calls it directly can ask for full care too, and nobody can get better than the published odds.

The contract’s exact odds match the figures above to within a hundredth of a percentage point. The mint page shows the effect of your care before you sign, and the Guide explains the ranks in more detail.

One look per familiar

Each familiar’s look (its species, palette, eyes, mouth, headgear, relic and marking) is meant to be one of a kind. If a new familiar’s look is already taken, the contract re-rolls its cosmetic traits, keeping its rank, House, species and star sign, up to 32 times. In the very unlikely case that all 32 tries are taken, the familiar keeps a look that another Aether already has.

All summons are final

Every summon is final and, to the extent the law allows, non-refundable, whatever your seals reveal. The contracts have no way to refund a summon. If a summon fails, for example because the mint is closed or sold out, your limit is reached or the price changed, no HYPE is taken from you except the gas.

Quest Board campaigns

From time to time we may run a campaign on the Quest Board: a few steps on X, a friend code to give to friends and a public board, with free Aether for the winning places at the top of it (the top 100 unless a campaign says otherwise). These rules apply to every campaign, together with the rest of these terms. The current campaign uses the X account @AetherElys, from 4 November 2026, 12:52 UTC until 8 November 2026, 04:00 UTC.

  • It is free, and no purchase is needed. You must meet the age rule in section 3.
  • One person, one X account, one wallet, one reply. Entries using more than one account are ineligible. Repeated replies earn nothing. One person can hold one winning spot. Team wallets cannot rank.
  • Rank is friends who finished, then who got there first. A winning spot needs at least one friend who finish every step. A spot with no eligible entry stays empty.
  • The steps run on trust. Before rewards, the top entries are checked by hand against these criteria: the reply exists, is yours, and replies to the campaign post; the account is real and in use; friends look real; the rules were kept. The result of that check is final.
  • Your reply must stay public until rewards are sent.
  • A friend code is optional. You can add one once, before your first step, and it cannot be changed. Your own code, the code of a friend who joined with yours, and codes of team wallets or removed entries cannot be used.
  • Posting your friend code unasked, or spamming it, is grounds for removal.
  • We may remove an entry that breaks these rules, and the next entry moves up. If you think a removal is a mistake, you can reach the Aether team at x.com/AetherElys (opens in a new tab).
  • The prize of the current campaign is 5 free Aether for 1st place, 3 free Aether for 2nd, 2 free Aether for 3rd and one free Aether for each of 4th to 100th place, on Elysium mainnet. A campaign on a test network pays on mainnet: once the mint goes live there, the reward is minted at no cost to the winner and sent to the same wallet address that signed in, so enter with a normal wallet you also control on mainnet. We set no date for this here and promise no value. Rewards are sent to the signed-in wallet. There is no claim page, no payment and no approval, and we never send a direct message first.
  • A reward is a free mint by the collection owner (see section 8), so it arrives sealed, like any summon, and the unseal window above applies. If the Aether contracts are not live yet, rewards are sent once they are, on no promised date.
  • Standings on the board are provisional.
  • By entering, you agree that the public board and the list of winners show your X handle and your wallet address shortened to its first 6 and last 4 characters, with your friends and points, and that the collection owner sees your full wallet address, to check entries and send rewards. The Privacy Notice says what is kept and for how long.
  • We may pause a campaign, move its end to a later time or close it early.
  • You can leave a campaign at any time with Leave and delete my data on the Quest Board. Once the winners are published, a winner can leave after the reward has landed, and the record of that reward stays.
  • X does not sponsor, endorse or run any Quest Board campaign.

Trading on other marketplaces

This website has no market of its own. It mints Aether and shows the collection, and it holds no listings, offers or HYPE for trades. Holders trade Aether on third-party marketplaces such as OpenSea, which has supported Elysium since day one.

  • Their terms apply. When you list, buy, sell or bid on a marketplace, you deal with that marketplace and with the other holder, under the marketplace’s own terms and privacy policy. We are not a party to those trades and do not set or review prices. We do not run OpenSea or any other marketplace, and a link to one is neither our endorsement of it nor its endorsement of Aether.
  • Check the contract. Before you buy, check that the contract address on the marketplace is the Aetherelysium address shown on this website: a copy of a collection can carry the same name and art.
  • Approvals. Listing usually asks you to approve the marketplace as an operator for your Aether, which lets it move them under its own rules. You can revoke that approval in your wallet at any time.
  • Royalties. The Aether contract tells marketplaces about a creator royalty of at most 10% (ERC-2981) and the address that receives it. Whether a marketplace pays it is up to that marketplace.

What the collection owner can and cannot change

The contracts give the collection owner the fixed set of powers listed below, and they cannot be upgraded to add more.

The collection owner can

  • open or close public summoning at any time;
  • change the mint price at any time, to any amount, including zero;
  • change the maximum supply, never below the number already minted and never above 10,000, until it freezes the supply, which is permanent;
  • set the per-wallet limit anywhere from 1 to 100;
  • mint vessels for free to any address, within the maximum supply; these always have full care and ignore the per-wallet limit and a closed mint;
  • withdraw the mint revenue held by the Aether contract: all of it to the owner address, or any amount of it to any other address;
  • replace the code that draws the art only until the art is frozen, and freeze it for good (the first summon freezes it automatically);
  • set the creator royalty that marketplaces are told about, at most 10%, and the address that receives it;
  • hand ownership of the Aether contract to another address;
  • run, change or take down this website and its settings.

The collection owner cannot

  • upgrade or replace the contracts’ code: there are no proxies, and the drawing code could only be replaced before the art froze;
  • move, burn, freeze or take your tokens, or pause their transfers;
  • change the art once it is frozen;
  • choose, preview or re-roll the outcome of any seal;
  • change the care rule or the published odds;
  • raise the supply above 10,000, lower it below the number minted, or change it after freezing it;
  • set the royalty above 10%;
  • rename, restyle, bond or attune your Aether, or remove a name you gave it;
  • take HYPE from your wallet;
  • give up ownership of the contracts: that function is disabled, so the contracts always have an owner.

Ownership and the art licence

When you hold an Aether, you own that token: the Aether contract records your address as its owner, and only you, or someone you approve, can transfer it. Its art is drawn by the Aether contracts from data stored on Elysium, so it does not depend on this website or on any outside file host.

Owning a token does not give you the copyright in its art, or any right to the Aether name or our other intellectual property. Instead, while you hold an Aether, we grant you a personal, non-commercial, non-exclusive, worldwide and royalty-free licence to display and share the art of that token, for example as a profile picture, in a wallet or gallery, or in posts about it. The licence passes to the next holder when the token is transferred, and ends for you when you no longer hold it. All other rights in the art are reserved.

No investment, no promises

  • Aether is not an investment. An Aether is not a security or a share in anything, and it gives you no claim on mint revenue, royalties or anything else.
  • We promise nothing more. We do not promise any roadmap, utility, future feature or support for the price, and the only reward we promise is the prize stated in a live campaign’s rules, on those rules, and we have no duty to keep working on Aether or this website.
  • Value can go to zero. The value of an Aether can go down as well as up, including to nothing, and nobody may be willing to buy yours.
  • No expectation of profit. Do not take part expecting a profit from our efforts or anyone else’s. Spend only what you can afford to lose.

Nothing on this website is financial, investment, legal or tax advice.

Risks

Using Aether involves risks that we cannot remove. By taking part, you accept them, including these:

  • Smart contracts. The contracts are covered by extensive automated tests, including fuzz, invariant and attack tests, but no testing can prove that code is free of bugs. A bug could lock or lose tokens or HYPE, and the contracts cannot be upgraded to fix it.
  • A new network. Elysium is new. At launch a single sequencer, run by Kinetiq, orders every transaction, and validation is permissioned. The sequencer could in theory influence the block hashes that open seals, and an outage or censorship there would stop summoning and trading.
  • Data availability. Elysium keeps its transaction data available through a committee (AnyTrust), with posting of the full data to HyperEVM as a fallback. This depends on that committee and that fallback working as designed.
  • Bridging and withdrawals. HYPE reaches Elysium over a bridge from HyperEVM, and moving it back is not instant: on the main network a withdrawal takes about 5.5 days to complete. Aether tokens cannot be bridged to other networks.
  • Wallets and scams. Fake websites, fake support accounts and harmful transactions are common. We will never send you a direct message first, and we will never ask for your seed phrase or private key. Check this website’s address, and the contract addresses in the Guide, before you approve anything.
  • HYPE prices. The price of HYPE can swing sharply, which changes what a mint, gas and every trade really cost you.
  • Seal timing. A vessel left sealed past the unseal window, which can be as short as about 11 hours, is revealed from a fallback value that could be worked out in advance.
  • The collection owner’s choices. The collection owner can change the price, close the mint, raise the supply up to 10,000 until it is frozen, mint free tokens within the supply and change the creator royalty within its 10% cap (see section 8). Any of these can affect what your Aether are worth.
  • The collection owner’s keys. If the owner key were lost, or ownership were handed to a wrong address, the mint revenue would be stranded, and owner settings such as the price or a closed mint could never be changed again.
  • Public data. Your address, your holdings, your trades and care, and any name you give an Aether are public and permanent on Elysium. A name stays in the chain’s history even after you clear it.
  • Marketplaces. Some traits change with the holder’s wallet or over time, and marketplaces such as OpenSea may show out-of-date details until they refresh them.
  • Law and tax. Rules for crypto assets and NFTs differ between countries and keep changing. They may limit your use of Aether or tax your mints and trades, and you are responsible for your own taxes.
  • Outages. Public RPC services can refuse busy traffic or go down, and this website can be slow, show out-of-date information or go offline. When that happens, you may be unable to act in time through the website, for example to unseal a vessel.

Services run by others

Aether relies on services run by others, including your wallet, the Elysium network and its operator Kinetiq, the RPC providers that the website and your wallet use, the block explorer, the faucet and the bridge, the company that hosts this website, and the marketplaces that list Aether, such as OpenSea. Each has its own terms and privacy policy. We are not responsible for them, and a link to one of them is not an endorsement.

Quest Board campaigns also rely on X, where their steps happen, under X’s own terms and privacy policy. The website never contacts X itself: its links open X in your own browser or app.

Things you agree not to do

When you use the website or Aether, you agree not to:

  • break any law or sanctions rule, or help anyone else do so;
  • use Aether to launder money, fund crime or hide where funds come from;
  • manipulate prices or trading volume, for example by trading with yourself or by coordinating fake activity;
  • attack, overload or try to break into the website, its relay or the Control Room, or get around their limits, for example by scraping at a rate that harms the service;
  • exploit a bug to take tokens or HYPE that are not yours (if you find one, please tell us);
  • pretend to be the Aether team or anyone else, or run copies of this website that mislead people;
  • give an Aether a name that is unlawful, hateful, harassing, sexually explicit, infringing or misleading;
  • use the art beyond the licence in section 9.

The contracts are public, cannot tell who is calling them, and give us no way to block a particular person. These promises are therefore not enforced by any technical means: they are part of your agreement with us. Names are stored on the chain for good, and we cannot remove them.

Disclaimers

To the fullest extent the law allows, the website, the contracts and the art are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We do not promise that the website or the contracts are free of errors or bugs, that they will be available at any given time, or that the information shown, such as prices, odds and balances, is complete or current. Information read from the chain can lag behind it.

Limitation of liability

To the fullest extent the law allows, the Aether team is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, tokens or HYPE, that arise from your use of, or inability to use, the website, the contracts or Aether, even if we were told such losses were possible.

Where our liability cannot be excluded, it is limited to the total of the mint prices you paid in the twelve months before the event that led to the claim. Nothing in these terms limits any liability that the law does not allow to be limited.

Indemnity

To the extent the law allows, you agree to cover the Aether team’s losses, liabilities and costs, including reasonable legal fees, from claims made by anyone else that arise from your breach of these terms, your breach of any law or your misuse of the website or Aether.

Changes to these terms

We may update these terms from time to time, for example when the website or the law changes. The date at the top of this page shows when they last changed. A change applies from the moment it is published here, and it does not undo transactions that are already confirmed. If you keep using the website after a change, you accept the updated terms; if you do not agree with them, stop using the website.

Severability

If any part of these terms is found invalid or unenforceable, that part is limited or removed only as far as necessary, and the rest of the terms stay in full effect. If we do not enforce a part of these terms at some point, we keep the right to enforce it later.

Contact

Questions about these terms? You can reach the Aether team at x.com/AetherElys (opens in a new tab). We will never message you first, and nobody from the Aether team will ever ask for your seed phrase or private key.
